These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the website optarionix.com (hereinafter, the "Site" or the "Platform"), operated by Optarionix S.A. (hereinafter, "Optarionix," "we," or "the Company"). By accessing and using the Site, you accept these Terms in their entirety.
1. About Optarionix
Optarionix S.A. is a corporation incorporated in the Argentine Republic, registered with the General Inspectorate of Justice (IGJ) under No. 18,274 of Book 95 of Corporations, with CUIT 30-72198456-3 and registered address at Av. del Libertador 6350, Floor 8, C1428ARS, Autonomous City of Buenos Aires, Argentina. We operate as a real estate crowdlending platform in accordance with current regulations.
2. Nature of the service
The Platform facilitates the connection between investors and real estate project developers through a crowdlending (collective lending) model. Optarionix does not act as a financial institution, bank, or stock broker. Participation in the projects published on the Platform constitutes a risk investment and not a bank deposit.
3. Requirements for use
To use the Platform's services, you must: (a) be at least 18 years of age; (b) have the legal capacity to contract in the Argentine Republic; (c) provide truthful, complete, and up-to-date information; (d) accept these Terms and the Privacy Policy.
4. Investment risks
Investments made through the Platform carry inherent risks, including but not limited to: total or partial loss of invested capital, project delays, changes in Argentine real estate market conditions, regulatory and currency risks. Past returns do not guarantee future results. Before investing, carefully evaluate your financial situation.
5. Intellectual property
All content on the Site, including texts, images, logos, designs, source code, and databases, is the property of Optarionix S.A. or its licensors and is protected by the intellectual property laws of the Argentine Republic (Law No. 11,723) and applicable international treaties. Reproduction, distribution, or modification without prior written authorization is prohibited.
6. Limitation of liability
Optarionix does not guarantee: (a) uninterrupted availability of the Site; (b) the accuracy or completeness of information published by developers; (c) the achievement of specific returns on projects; (d) the absence of technical errors. Optarionix's liability shall, in any case, be limited to the maximum permitted by applicable Argentine law.
7. Personal data protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. We comply with Law No. 25,326 on Personal Data Protection and its supplementary regulations.
8. Modifications
We reserve the right to modify these Terms at any time. Changes will take effect upon publication on the Site. Continued use of the Platform after any modification implies acceptance of the new Terms.
9. Applicable law and jurisdiction
These Terms are governed by the laws of the Argentine Republic. Any dispute arising from their interpretation or compliance shall be submitted to the National Commercial Courts sitting in the Autonomous City of Buenos Aires, the parties waiving any other forum or jurisdiction that may correspond to them.
